My name is Eric Applebaum. I am an attorney in Springfield, Massachusetts. I am a plaintiff in a case against US Bank
which is going to trial in the next few weeks. While my case is very small, the results could have widespread implications, and could expose US Bank to millions of dollars in liability exposure. I would like to go public as soon as possible through your website to set up a class action against this bank. My lawsuit will lay the groundwork. In November of 1999 US Bank took over a second mortgage my wife and I had through First Plus Financial. The loan with First Plus was administered as a standard mortgage, with a due date, grace period, etc. When US Bank took over the loan they converted it from a standard mortgage instrument to something called a "daily simple interest" loan. U.S. Bank then issued a letter which was fraudulent. Specifically, US Bank asserted that "any early payments received before the due date would reduce principal". This was not true. In fact, if the debtor issued an early payment they risked owing additional interest if the next payment was received by the bank at or near the usual due date. Although the damages in my case might be considered limited, I want to take my case all the way through trial and obtain a judgment with regard to the letter. If I obtain a judicial finding that the letter was indeed fruadulent, a class action can be formulated and my little judgment can be used to bludgeon these bastards. The case is titled: Eric Daniel and Sarah Applebaum vs. US Bank National Association. Trial Court of Massachusetts. Hampden County Superior Court, Civil Action Number 01-1235. We asked in July (2002) to have our mortgage payment deferred and were told we could not until it was actually late. In
August we called to have it deferred (July pmt) and were told that since we were refinancing not to worry about it. On August 30, both my husband and I talked with different loan officers (Ronnie ? and Jerry Vanderhoff) and were told we were liars, good for nothings that didn't think they had to make payments, trying to get something for nothing, etc... I'm sure you get the general gist of the abuse. We were also told that we had until 6:00 pm to send them $1793.21... july pmt, august pmt and sept pmt... even though the July pmt is the only one over 30 days late (pmts due on the 17th of each month). We were informed by these people that they would personally ruin our credit, refinance and put us out of our home the following week. Today, we received Notice of Intent to Foreclose, ! even though we are still legally only behind on the July pmt! We are being torn apart by these people... if I had ben gang raped it would have been less violating than the way I was spoken to and threatened by them. Even though I NEVER mentioned an attorney or legal action, I was told that if I "had it in mind" to speak with an attorney that they (US Bank) had "hundreds" of attorneys working for them and that not only would I lose my home but everything I had. I have filed a complaint with the FTC and if I can get the addresses and names wish to also send copies of the complaint to US Bank's corporate headquarters... Your website is MUCH NEEDED.

US BANK IS INFAMOUS FOR LYING! Example: I recently sent in a payment to make a payment to my reserve line, utilizing the
address a rep gave me after I called the 1-800-USBANK line...the address was located In Milwaukee, WI) Several weeks later, I received the same amount back, in a new check written by US BANK, with a computer generated note, stating that the money was not needed for your reserve line, or "you have paid too much." I'm like.…what??? Several days later, I started getting calls from collections, so naturally, I vented a bit, talked to several reps, and finally a manager…During the conversations, they said all this will be documented...…What sent my blood pressure up several notches later that week, was I called back, to ask some questions on the calls I made…and lo and behold, there were no notes, "documenting the call…" in fact, another rep told me, "…we don't document those calls…" perhaps it was collections you were speaking with.… The point here, is that it was the general 800-usbank helpline, and I don't care if I was talking to the VP of USBANK, I was CLEARLY LIED TO AS SOMEONE TOLD ME DURING THE 45 MINUTE PHONE CONVERSATION, that all notes will be documented.….. So.…now I'm being charged interest for the month I'm behind, since USBANK returned my full payment, stating it was not needed (what???) as indicated earlier in this story.…Now, they want me to get a copy of the canceled check from my bank---which will cost me more money, and fax it to another manager.…It seems…they do not have the ability to track the original USBANK check, written to me, with my account number.…..Wouldn't one think that they keep records of checks written to individuals??? If anybody has similar experiences.….please…please…let me know.…I'm sorry if this is long winded, but, the fact of lying…not being able to cover your tracks…or even keep simple business records of how much a company pays to whom…seem simply odd…don't ya think? Please respond…if you can

US Bank is still up to their same BS. I'm currently going through a similar ordeal with their credit card division. I had some
unauthorized charges start appearing on my credit card early last year. The merchant was unresponsive, so I began disputing the charges through US Bank. While the disputes were resolved in my favor, I got the runaround every step of the way. Finally fed up, I instructed US Bank to close the account and stop processing ALL charges in July 2001. But they went ahead and continued allowing charges to go through (new charges as well as charges from the original merchant, that they KNEW were unauthorized). I've been disputing the transactions since then, but they're refusing to cooperate. They ignored 3 separate instructions to close the account and stop processing charges, are refusing to reverse the charges, have reported on my credit history that the payment is 120+ days past due, and reported the account as "closed due to serious delinquency"! . All the while they're continuing to give one BS excuse after another, have made multiple outright lies in their correspondence, continue to harrass me both at home and my place of business despite multiple cease and desist orders, and continue to claim I owe them for these unauthorized charges. US Bank is nothing more than a bunch of thieving a-holes. They're committing fraud, violating the FCBA and FCRA, and are trying to extort money from me.

Wow, I thought I was the only sane person in an insane asylum until I read these other complaints. We had a home
mortgage written in 1998 through USBank. Our mortgage coupons didn't arrive as expected to allow us to make payments. I called Customer Service many times, using my vacation hours from work to wait on hold and tell my story to 50 different people who really didn't give a rip. After three months of extensive calling and not getting anywhere, I finally get a nice bank manager who manages to trace our account history. His records showed our mortgage as paid in full and up to date. What?? Unfortunately, nothing was linked together to give us the proper information of how this transpired. On month 4, I receive a payment coupon (yippy!) for the mortgage. However, I also received a statement for a USBank credit line account that they took the liberty of opening in our name without our consent. They had been paying the mortgage payments by transferring money out! that account! The mystery was solved. Very upset, I called USBank. They informed us that WE were ultimately responsible for this mishap since we are the mortgage holder. So, we now had a credit line account with a balance owing of 3,200 and interest of about 14.99%. My home loan was set up with an interest of 9%. They also opened up a checking account that I had no knowledge of and were charging us monthly fees for maintenance and such. This resulted in a negative balance in a checking account that I never even knew existed. No problem! Soon after, they transferred the money out of our credit line account to pay it. This whole system was taking a life of its own without our control or consent. We ended up paying the credit line account balance at 14.99% interest, with late payments for three months at $29 a pop, in addition to our mortgage bill. What blows my mind is that USBank had the power to set up accounts without a signature or approval from us. If they can do this to us, what would stop them from setting up all kinds of bogus accounts and transferring monies in some unsuspecting customer's name. I have switched to a much more customer-oriented bank since and have not had any problems. Since then, I have read a book (just by happenstance) called "Escape to Jekyll Island," about the power of the banking system. It's one guy's theory, but it had an impact on me after what I'd been through. You should read it. Oh, yes, and hey USBank! I just inherited $400,000 and not one penny will go to you. Too bad you don't treat your customers better!

Hello there. I'm very happy to see this site. I am a FORMER employee of US Bank. I worked at the Commercial Loan
Services processing center in Oshkosh, Wisconsin. I have been privy to many of the fraudulent practices done by them. I was fired when I refused to follow my bosses orders to change loan documentation without proper customer signatures. They dubbed me a "trouble maker" for standing up for what was right. Not only do they treat their customers badly, they also treat their employees badly. We were forced to sign a paper saying that we could not "discuss in any way our salary or disciplinary actions with another employee." It was complete bull-shit. I checked on it and they could not do that by law. Two employees were fired while I was there for doing just that. I urged them to take it to court and US Bank ended up paying quite a substantial dividend to the two women. They took away our breaks if we wouldn't do what they wanted us to, they wou! ld punish us as a group because of what one or two people had done, and they were always very mean to us. My boss would yell and scream at us at meetings. I tried complaining about this treatment to HR and the higher ups and nothing was done about it. At one point while working there, I had a loan I was supposed to enter into the system. The loan document clearly stated that the loan's interest rate should be 1%. My boss came by and told me that the loan was wrong and I should enter the interest rate at 10% and it would be sent back for customer signatures after I entered the loan. I told her that I would do no such thing, that the signed document said 1% and that is what I would enter, if they wanted to change it, an amendment would need to be drawn up. I was then written up and put on disciplary action because I wouldn't follow her orders. I hate US Bank!

This is our nightmare. It is a lengthy story but the details are crucial I think to impress the scope of this banks behavior and how it
has tore apart our lives. WELCOME TO MY PERSONAL HELL! My husband and I decided to refinance our home mortgage with our local Firstar US Bank due to lower interest rates, in Aug 2001.
In April of 2003 a friend called to say that our house was in the legal notice of local newspaper as a forclosure notice. I
immediately called the local bank where we had done our mortgage and was told to call the branch office in our nearby capital city. I was connected with a woman named Mary Louise ?. After many days of run around she assured me the problem had been found and that there was a transposed number in our acct. # so that our pymts. were being credited to another acct. She assured me she was crediting our acct. with all these pymts. Three days later I again called the same number and extension and got Mary Louise. I asked her if everything was taken care of and if there was different acct number info that I needed to mail my pymts. She replied that our # was unchanged and that she had corrected everything in the system. Life goes on........right...... We received no futher correspondence from US Bank, phone calls, notices or anything. We assumed everything was fine. Never assume anything with US Bank!
On Saturday morning, August 16, 2003, We received a phone call from my husbands brother. He asked if we knew that our
house was again in the legal notice section of the newspaper but this time it was a notice for Sheriff's Sale. It was to be sold to the highest bidder on August 27, 2003 at our courthouse. We were dumbfounded. We had received no court papers, notices from US Bank or the law firm representing them. We called US Bank with the ext. for Mary Louise only to get a voice mail mess. belonging to someone named Don. We left mess. that we were trying to reach Mary Louise with US Bank regarding our mortgage, and left our name and acct. number. We received a return call from this Don that he didn't know who Mary Louise was and that he knew nothing about our mortgage. We then called our local US Bank and spoke to a branch manager named Karen _____. She told me to come into her office on Monday morning and to bring my cancelled checks, receipts, ect. with me. I scrambled around trying to get all this together because in less than 10 days they were going to try to sell our house! On Monday morning I arrived at the bank with cancelled checks, money order receipts, and receipts given to me by that bank for cash pymts. I had made. I was informed by the receptionist that Karen was unavailable. She said she was not sure how long till Karen would be able to see me but I could sit and wait. (Now I have 4 children who were out of school for the summer, with me. I did not have anyone who could keep them for me.) I had all my things in a business size envelope. Being an idiot, I sealed the envelope and wrote Karen's first and last name on the envelope in black ink and asked if she(the receptionist) would give this to Karen and have her call me when she was available so I could come back in.
I didn't hear from her, so that afternoon I called and the receptionist told me she was gone to lunch and would be returning at 2
pm. At 2:05pm I called and was informed that she was on the phone with a client and would I like to leave voice mail. So I left mess. aking her to please call me regarding the documents I had left for her that morning and what was being done about it. She never returned my call. The next day was much of the same runaround. I was growing quite frustrated! By Wed. I was livid. My husband took the day off from work. We spent much of the morning trying to obtain copies of checks from our old bank who we only had carbons. We arrived at the bank after lunch time and was told that Karen was still out to lunch and that she would be back at 2pm. It was 1:30. We went to the courthouse to review these documents and see if there were suppose to be any papers served to us. Sure enough there it was. That they served forclosure papers to my husband himself on Jan.25,2003 at our front door. Let me interject here that we only have less than 3 years left on our mortgage at this point. We have remodeled and almost doubled our living space and the price of our house and property. I can guarantee you that if we were served any form of papers in Jan. or any other month, we would have been there with bells on to straighten it out. They want to sell our house for $42,000.00 when it's easily worth $85,000.00 to $100,000.00, due to the blood, sweat, money and tears that we have invested in it over the last 12 years. Anyway, we went back to the bank at 5 minutes after 2 that afternoon. Upon arriving we were informed that we would have to have a seat and wait that Karen was on the phone. We sat there from 2:05 until 2:55 waiting to see this woman. I then approached the receptionist and told her that we have been waiting almost an hour and that I had children coming home from school. I said that I would call from home and see when would be a good time for Karen to see us. That apparently I might have more luck talking to her on the phone than sitting for an hour waiting to see her. We were so enraged!!!!! At 3:15 I called and was told Karen was still on the phone! At 3:30 I called and was told that Karen was still on the phone! I left voice mail mess and waited. At 3:45 we still had not heard from Karen. We got the children in the van and arrived back at the bank at 3:55. The receptionist told us that Karen was still on the phone but if we wanted to wait she would tell her we were there as soon as she was off the phone. By this time we were about to blow a gasket! We waited for approx. 10 minutes when Karen appeared and asked us to follow her to her office. My husband asked her what was being done about our mortgage and she said that she was still waiting for us to bring her the information. I told her I had left it at the desk for her on Monday and that I had left several messages for her to return my calls. She looked at me and subtly implied that I had never left anything for her, that I was lying. Furthermore she stated that US Bank had never employed a Mary Louise and that the extension number I had given them belonged to another company who occupied that office in US Bank, and that they had never employed a person named Mary Louise either. I said, " It was US ! Banks phone number and I reached that extension numerous times and spoke to this Mary Louise who was suppose to have this all straightened out back in April. I also think that you need to start looking for that envelope that I left here Monday. It has all my proof in it." Anyway she kept saying out of one side of her mouth that she wanted to help us but calling me a liar out of the other side. I got up and left her office before I exploded. Afterward she started implying to my husband that maybe I was the one deceiving him about this matter. My husband blew up and asked for the vice president of the bank and told her that he would have no further dealings with her when she would be so rude and disrespectful to me and to him.
The VP gave us a number with the name of Debra ______. This is who our acct was turned over to when it went into foreclosure.
It is an asset collection company contracted by US Bank. I have yet to meet a more uncaring, rude, and snotty person as this woman. (Except maybe Karen!) I called this woman and tried to explain that we were waiting for more copies because the bank here had lost mine. That we were unaware of this whole matter until a few days ago, ect. She informed me that she had notes on our file that someone had talked to owner's spouse and that I had said this or that. I said, No, ma'am, you are mistaken. No one from your office has contacted us at any point in this nightmare. She then informed me that unless I could fax her copies of all missing payments by the end of the day on the 26th that they would see us at the sale Wed. morning and hung up! After this it was just more of the same shit. Everyone saying they wanted to help, but no one actually doing anything! They have still not produced my envelope... that set us back days and days while waiting for more copies from our bank where our checking is. On August 26th we ended up having to file chapter 13 bankruptcy to keep them from selling our house because we could not get more copies in time. With the bankruptcy still pending, I have filed complaints with the FTC, the Federal Banking commission, and the Attorney Generals Office. We are now looking for a lawyer to hopefully file a class action lawsuit against US Bank. I can not tell you of the emotional, mental and psychological toll this has taken on my husband and I. In just a few short weeks, we have almost separated, our life is in turmoil and the children are also affected, being to young to understand what this is all about. I pray to God daily to give us the strength to defeat this evil that has entered our lives. I only hope we can endure. Thank you for this website and the chance to share this with you all.

just wanted to say thanks for the reply to my submission. Other than actually finding and reading all the stories in this web
site and numerous others, yours is the first response I have had other than the form letter to say my story was accepted. Every little bit of encouragement is monumental to us in this endeavor .
I also wanted to say that after talking to the Vice President of our local branch this morning, I asked him if he was aware of
the numerous complaints and litigations filed against US Bankcorp. I was not surprised to see he was totally clueless. The look on his face was a definite Kodak moment.

I am starting a Class action law suit against US Bank, if any one wants to join up, let me know. Below is the info I gave
to the attorney. September 25, 2003 I would like to initiate a class action lawsuit against US Bank on my customers and my behalf.
About 2 ½ months ago, US Bank had a rate special as the rest of the conventional market was going up in rate
drastically, they did not. What US Bank did to stop some of their losses was to quit finalizing the loans so they would not be finished and they could cut their losses. I spoke with three managers, including one high up in the corporate office in Minneapolis. His name was Peter, and he told me that they had about $1.3 billion in their pipeline, but could only realistically fund about a third of that amount they had locked. I proceeded to tell him and the other managers that this would harm borrowers and we had locks on many of our loans. Said there was nothing he could do about it. We made every attempt to get US Bank to honor their locks and agreements, but they continued to employ stall tactics designed to make the loans go away to other lenders and lessen their problem.
I sent one of my borrowers directly to the phones of the corporate offices of US Bank in Minneapolis. One of the head
people there, Peter was the person he was instructed to talk to. The manager would not take his call and the borrower was told that Peter does not deal with borrowers. I then told my borrower to mention the Class Action he would start if he did not get his loan closed. The manager jumped all over this and called the borrower back in 5 minutes after my borrower let Peter have it for 2 hours, he gave in and closed his loan very quickly. The loan and all the final loan conditions, had been at US Bank for the previous 3 weeks with no progress, suddenly it was being moved to front of the line. When we did get paid on the loan, US Bank kept $4,000 of the $9,000 we were to receive for their troubles.
I have heard many other brokers telling the same story and know that US Bank did this disservice to many others
across the country and the scope of this case is huge. I have e-mails from another borrower that US Bank actually gave to another broker illegally, even though we were the first in their system with this loan. Many of these borrowers had to take higher interest rates as when we found out they were not going to close them the market had gone up farther. Many, many borrowers suffered this injustice and want to join this Class Action Lawsuit and that is just the tip of the iceberg. There would be thousands of people who would join in on this and were harmed by US Bank's actions. The damages in a case like this is astronomical! We have a good amount of supporting documentation on this to back our claims.

My husband and I decided to refinance this year and build a garage. First off they had this wonderful building loan where
you refinance and get the money needed to do the work and there are no closing cost( they will do the appraisal for free) so we did. Our payments were suppose to be around 285 a month they turned out to be almost 500! After the garage was done we were suppose to refinance again for 6.5%, as long as the property appraised high enough. The same deal was to apply. A drive by appraisal from the same man.
The first appraisal was $41,500 (without the garage) Now, the man says it is only worth $46,500. with the garage! My
husband done all the work because he is a construction worker. We spent $11,000 on materials alone. US Bank says the building is only worth 5,500. It is a $20,000 building! Now they want us to pay $250.00 for a full appraisal, but they cant say that this will increase our value. Or, the other thing we can do is take a 9.5% interest rate and pay an extra $19,000 over 20 years because they say our place is only worth $46,000 when it is really worth $53,000. We offered to pay a different appraiser but they refused. We have to take the same man that did it the first 2 times and they won't even let us speak to him or contact him. By the way they pay him to do all the drive by appraisals.

I suppose its ignoble of me to draw comfort in the misery of others, but your story Jerry, makes me feel a little less lonely. I
don't have the energy to recount my tale of horror at the moment, as I'm trying to recover from an asthma attack in no small part aggravated by US Bank and Beneficial-Household (if US Bank screws you, Beneficial makes you swallow). I had make some queries to our state's Attorney General about filing against US Bank, but considering the last "hit" by US Bank cost $1,500 in fees in one month which we haven't recovered from, pursuing a law suit is beyond our ability financially, so I gave it up. Regardless, your site has cheered me considerably as I feel less that we are under a psssssssst cloud (Lil' Abner circa 1960) and targeted, than just another of the minions. Thanks!

HERE is the kicker, I am currently buying my dream-home in another state. I'll make this short because it is very lengthy. I
went to US Bank for the loan. They told me they had an 80% first and a 20% home equity loan package that would be perfect for the purchase. Well, the loan officer out of state called me once to get the loan rolling, then would not return my emails, or phone calls. For three weeks, I waited. Then I finally was told that she forgot---or the appraiser never go the request to complete the appraisal. That put us behind almost two weeks. Then on the day we were suppose to close escrow, she asked me where I was getting the 20% down. She said they don't sell the 20% home equity loan on new purchases. Well, I had to go to another bank to get the additional funds.. At this point, I am too far into this purchase to change lenders. But as soon as it closes, I'm refinancing, and closing all of my accounts with this bank. The only good thing about all of these problems is that with all of these complaints. They too soon shall be swallowed up by the competition!

I own a small business. I had done business with USBank for quite a few years. A few years back, we got a contract that
required some specialized equipment. I figured it was smarter to use a loan to buy the equipment, and pay off the loan when the contract paid rather than diminishing cash flow.
I went to my USBank branch, filled out an application for a loan and turned it in. This was a small loan, less than $6,000, and
I had had many similar unsecured loans approved at other banks over the years. Not USBank. Right off they said the loan would need to be secured. So I offered the contract as collateral. It was signed and sealed and worth over $30,000. Nope, wouldn't take it; they wanted something "tangible" (?).
But the funny thing is, less than 2 weeks later I got an offer from USBank to open a line of credit with a limit of twice what I had
asked the loan for. The only difference was that the credit line interest rate was substantially higher than the loan rate. Basically they just figured they could squeeze more interest money out of me with the credit line.
When you're a small business, you need a banker that will work with you as a partner. USBank proved to me that they weren't
interested in that kind of relationship. I took all my money out of USBank and went to a local bank where they actually care about me and my business. Glad I got out when I did because it sounds like they just have gotten worse.

I have an interesting Firstar / US Bank story. During the "tech bubble", I was a techie internet guru in big demand everywhere
and commanding big bucks in salary and options. Me and the family kept moving from job to job, taking bigger and bigger salary offers, all through the 90s and amassed quite a nest egg. Towards the end of the 90s we decided maybe it was time to settle down. Decided to move back to where our aging parents were located, and I set up my own internet/technology consulting company.
After renting for 2 years we decided it was time to buy a house. We were interested in something in the $500k - $700k range.
So I went shopping at different banks and mortgage brokers for the best deal, and to get pre-approved before we started seriously house hunting.
I included Firstar, just recently turned US Bank, because our families had banked with them and the various predecessors for
many years. Walked into a local branch with my paperwork and income documentation, and a just barely twentysomething guy said he would help. He plugged all the numbers into his computer, and we waited a bit for it all to be digested. Then he came out and said, I sorry Mr.-------, there's nothing we can do for you in that price range. I looked at him puzzled and asked why, and he said, because you clearly can't afford that much. Even more puzzled, I said, there must be a mistake ----- maybe you entered some numbers wrong. And he said, no, I double checked. The computer says you can't afford to buy anything over $200k.
What?? I said, you must be joking. No he says, I'm afraid you'll just have to set your sights lower. $200k? That won't even
buy me a fixer upper! Sorry, there's nothing I can do about the fact that you don't have enough income, he says. So now I'm ticked. I yell to him as he walks away. Hey dipwad, you do realize that 2 years ago I made more in salary than you'll probably make in the next 20 years total. You do realize that I probably make more in 2 months right now than you make in a year. How dare you and your obviously defective computer system suggest that I can't afford anything over $200k.
By now the branch manager hears the commotion and comes over. When I explain what happened she says, well, there's
nothing I can do about it. We just accept what the computer tells us. So, I walk over to the teller windows, hand the teller 5 withdrawal slips, and tell her I want to close out all of my accounts: give me the money in a cashiers check. And she says sweetly, sir, I need to know why you want to close your accounts. And I say, because I want my damn money out of this crazy bank. Oh, I need something better than that to put on this form. I said, I want my money, and I want it now, and I don't have to explain why to you or anyone else. The manager comes running over and says, Mr. ------, you'll have to keep your voice down or I'll have to have you removed. What, you're afraid that all the other customers will find out how shitty this bank is?

Well I did finally get my money and I've never been back into or done any business with US Bank again. Sounds like they
haven't gotten any better. And by the way, I went to a mortgage broker and 7 months later my wife and I bought a modest $760k home. That twit at US Bank is probably flipping burgers for $5 an hour. Then again maybe he turned out to be just what US Bank wants in its executives.

Neat web site. I was thinking of taking out a mortgage through U.S. Bank. I decided to do some research first and
found your site listed at epinions, and followed the link here. After reading what they have been doing to other folks there's no way I'm doing business with U.S. Bank. The rates they offer arent that great. Thanks for the info.
